Abstract This chapter examines Chapter II of the EU Artificial Intelligence Act (AIA), which regulates prohibited AI practices under Article 5. It explores the ethical and legal foundations of these prohibitions, aimed at safeguarding fundamental rights and EU values. The analysis addresses outright and qualified bans on practices such as manipulative techniques, exploitation of vulnerabilities, social scoring, predictive policing, facial recognition, emotion inference, and biometric categorization.
It also explains the complex regime governing real-time remote biometric identification systems in publicly accessible spaces for law enforcement, including conditions, safeguards, and Member State authorizations. The chapter situates these rules within the broader regulatory architecture, highlighting their interplay with high-risk AI systems and data protection law.
